2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103(1) and 238 of the Bharatiya Nyaya Sanhita (BNS), 2023.

3. The case of the prosecution is that wife and daughter of the informant have gone to pluck flowers for worship but they did not return home after considerable time. They were being searched. On search, the son of the informant found the dead body of his mother and sister near Uchit Singh Primary School. Accordingly, the FIR was lodged against unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. Moreover, the petitioner is languishing in judicial custody since 19.08.2024 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail stating that during investigation, this petitioner was apprehended and his confessional statement was recorded. In his confessional statement, he has accepted that he had illicit relationship with the deceased and that he has committed the offence in association with one Rahul. From the case diary, it is clear that there was some call with the deceased and the petitioner which goes to show that the petitioner was having talking terms with the deceased. From perusal of the post-mortem, it transpires that the Rinku Devi (deceased) had received altogether nine injuries on her person. From perusal of the paragraph-17 of the case diary in which petitioner stated that he and Rahul assaulted with knife to Rinku Devi (deceased) and incised wounds are also found on the persons of the deceased. Considering the aforesaid facts and circumstances of the case and the submission put forward by the parties, I am not inclined to grant bail to the petitioner which is according

However, the petitioner will be at liberty to renew his prayer for bail after three months.
