2. The petitioners are apprehending their arrest in connection with Sonpur @ Sonepur P.S. Case No. 931 of 2024 dated 08.11.2024 registered for the offences under Sections 189(3), 191(1), 191(2), 132, 221, 223, 285, 292, 352, 351(2) and 351(3) of the Bhartiya Nyaya Sanhita, 2023.

3. As per prosecution case, the accusation against the accused persons including the petitioners is of blocking the Chapra-Patna main road to protest against an accident.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the instant case. It is next submitted that the allegation made against the petitioners is general and omnibus in nature and their names have transpired in this case on the basis of the identification made by the local Chowkidar as also from the videography so done. The reasons behind blocking the road was the accidental death of the local boy who died in course of treatment. It is the case of the petitioners that the F.I.R. has been lodged against the seven named accused and 200 unknown persons and the petitioners further submits that three named accused persons have already been extended the privilege of anticipatory bail by a Co-ordinate Bench of this Court vide order dated 07.03.2025 passed in Cr. Misc. No. 9736 of 2025.

5. Learned APP for the State opposed the prayer for grant of anticipatory bail.

Considering the fact that the petitioners' name has transpired in this case on the basis of the statement of the local Chowkidar as also the videography and taking into account that the allegations made against the petitioners are general and omnibus in nature as also the similarly situated co-accused persons have already been extended the benefit of anticipatory

Patna High Court CR. MISC. No.84626 of 2025(2) dt.24-12-2025 3/3 bail, this Court is inclined to grant privilege of anticipatory bail to the petitioners.

7. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the Court below within a period of four weeks from today on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra in connection with Sonpur @ Sonepur P.S. Case No. 931 of 2024, subject to the condition as laid down under Section 482(2) of the BNSS, 2023.
