====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-06-2020 Heard Mr. Kalyan Shankar, learned counsel for the petitioner and Mr. Mohammad Sufyan, learned APP for the State.

The petitioner seeks bail in connection with Udwant Nagar (Gajranganj) P.S. Case No. 177 of 2019 dated 13.05.2019 instituted for the offence under Section 366A of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is a delay of about 10 days in lodging the FIR. Apart from this, it has been submitted that when the girl was recovered, she made her statement under Section 161 Cr.P.C., before the police in which she has not named the petitioner. However, later, on tutoring, she has named the petitioner under Section 164 Cr.P.C. as having ravished her.

Patna High Court CR. MISC. No.80268 of 2019(3) dt.05-06-2020 2/2 Regard being had to nature of accusation levelled in 164 statement, I am not inclined to grant bail to the petitioner for the present.

Accordingly, prayer for bail of the petitioner is rejected.

The petitioner may renew his prayer for bail, if there is no substantial progress in the trial. (Ashutosh Kumar, J) krishna/- U T
