Petitioner seeks bail in connection with Bettiah Muffassil P.S. Case No. 353 of 2018 registered for the offence punishable under sections 363, 366A of the Indian Penal Code and Section 12 of POCSO Act.

Learned counsel appearing for the petitioner submits that merely on suspicion petitioner has falsely been implicated in this case. As a matter of fact, the victim girl namely Shilpi Kumari in her statement under section 164 Cr.P.C. (Annexure-2) has not stated anything against this petitioner. Petitioner has no concern with the alleged occurrence. Petitioner has no criminal antecedent and is in custody since 16.07.2018.

No.58278 of 2018(2) dt.28-09-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act, Bettiah, West Champaran in connection with Bettiah Muffassil P.S. Case No. 353 of 2018.
