SONI SHRIVASTAVA ORAL ORDER 05-12-2025 Learned counsel for the petitioner has prayed for modification of the order dated 25.07.2025 for seeking deletion of paragraph no. 8 of the order wherein it has been stated that in case the petitioner is found to be made an accused in any further case of similar nature, his bail bonds in the present case would also automatically stand cancelled. It has been informed by the learned counsel for the petitioner that another case has been instituted against the petitioner on mala fide grounds only with a view to frustrate the privilege of bail granted to the petitioner in the present case as the same has been lodged on 20.09.2025.

2. This Court would not be exercising its discretion in deleting paragraph-8 of the said order. However, it would be

No.85449 of 2025(2) dt.05-12-2025 2/2 expedient in the interest of justice to indicate that the petitioner had been granted the privilege of anticipatory bail after consideration of merits of the case and in case the petitioner surrenders and seeks regular bail, the same shall be considered preferably on the same day, taking into account the fact that the privilege of anticipatory bail on merits had already been granted to the petitioner.

3. Accordingly, this application is disposed of with the aforesaid observations.
