The Petitioner seeks regular bail in connection with Sessions Trial No. 646 of 2017 arises out of Kudhani P.S.Case No. 203 of 2013, registered for offences punishable under Sections 302, 201, 328 and 34 of the Indian Penal Code. Allegation against the petitioner as per F.I.R. is that the petitioner along with others have committed murder of the younger brother of the informant by administering poison to him and cremated his dead body due to the fact he has sold the ancestral land and kept money along with him and his wife and mother-in-law was pressurizing to hand over money to them and ultimately, the informant had received telephone and when he went there, his dead body has already been cremated. No.58119 of 2018 (3) dt.01-11-2018 2/2 except suspicion, there is nothing against the petitioner and as a matter of fact, there is dispute between the deceased and his brother and the deceased had committed suicide after taking poison and the petitioner has no criminal antecedent, moreover, the petitioner is in custody since 30.05.2017. Heard learned A.P.P also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional sessions Judge- 13th , Muzaffarpur, in connection with Sessions Trial No. 646 of 2017 arises out of Kudhani P.S.Case No. 203 of 2013, subject to the following conditions that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
