JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-11-2023 In compliance of the order dated 1.5.2019, passed by this Court in CWJC No. 4426 of 2019, the District Education Officer, Bhagalpur, by an office order dt. 24.10.2023, has granted the benefit of first MACP to the petitioner with effect from 19.6.2015.

However, it is the contention of the learned counsel for the petitioner that the actual momentary benefit has not been paid, to which the learned counsel for the contemnors submits that the same would be paid, expeditiously.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present contempt petition with a direction to the District Education Officer, Bhagalpur, to ensure that the monetary benefit, emanating out of grant of

Patna High Court MJC No.4867 of 2019(6) dt.03-11-2023 2/2 the benefits of 1st MACP with effect from 19.6.2015, is calculated forthwith and paid on or before 24th of November, 2023, failing the District Education Officer, Bhagalpur and the District Magistrate, Bhagalpur, shall not draw their salary. 4.
