The petitioner seeks regular bail in connection with Bhagwan Bazar P.S. Case No. 203 of 2018 for the offence registered under Sections 364, 302/34 of the Indian Penal Code. The allegation is regarding the co-accused person namely, Dinesh Rai, having come to the house of the informant and taken away his brother, namely, Shibbu Pandey, however, subsequently, his dead body was recovered.
The learned counsel for the petitioner has submitted that the dead body of the deceased has been recovered on the basis of the confessional statement made by the said co-accused namely, Dinesh Rai and in his confession he had further named four co-accused persons, one of them being the petitioner and

It is further submitted that the said Balchand Rai has been granted bail by a coordinate Bench of this Court on 19.12.2018 passed in Criminal Misc. No. 66493 of 2018. Lastly, it is submitted that the petitioner is languishing in custody since 16.10.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S.
