1. Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Naanpur P.S Case no.470 of 2023 registered under section 379 of the Indian Penal Code.

3. As per the prosecution case, the informant states that on returning after having seen the celebrations of Krishna Janmastami, he found his vehicle missing from where he had parked. He states that he suspects the petitioner and one another of having a hand in the occurrence.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. It is stated that

Patna High Court CR. MISC. No.4847 of 2024(2) dt.07-02-2024 2/2 contrary to the allegations, no incriminating article was recovered on the petitioner's statement. He is in custody since 15.9.2023 and has no criminal antecedent. Charge-sheet has been submitted in the case.

5. The prayer for bail is opposed by learned A.P.P for the State.

6. Having heard learned counsel for the parties and taking into consideration the contents of the order of the learned trial Court, the allegations against the petitioner in the FIR, his being in custody for more than 4 months since 15.9.2023, not having any criminal antecedent and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Naanpur P.S. Case no.470 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi/ SDJM, Pupri, Sitamarhi.
