JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This is an application for grant of anticipatory bail in connection with Shankarpur P. S. Case No. 107 of 2019 disclosing offences under Sections 366A & 134 of IPC and Section 12 of POCSO Act.

As per F.I.R. there is allegation against the petitioner of kidnapping the minor daughter of the informant. Learned counsel for the petitioner drawing my attention towards the Annexure 2, which is the statement of the victim girl under Section 164 of Cr.P.C. has stated that she has not taken the name of the petitioner and also not stated any overt act against the petitioner. The medical report disclosed that she is aged in between 15-17 years.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.76999 of 2019(2) dt.20-01-2020 2/2 submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-I, Madhepura, in connection with Shankarpur P. S. Case No. 107 of 2019.
