2. The petitioner seeks bail in a case registered for offence under Sections 302/34 of the Indian Penal Code.
3. As per prosecution case, the marriage of informant's daughter was solemnized with one Gautam Giri eight years ago and it is alleged that on 25.06.2023, her son-inlaw Gautam Giri informed that her daughter has died, while he was not present at his house. It is further alleged that when informant came to matrimonial house of her daughter, she came to know that this petitioner and co-accused Gita Devi assaulted her daughter and committed her murder by wrapping Saree around her neck and thereafter, threw her dead-body in the field

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not family member, rather he is next door neighbour and has got no concern with the deceased. As a matter of fact, the deceased herself committed suicide by hanging after altercation with her in-laws family members and since, there is previous enmity going on between the family members of both parties, the petitioner has been falsely implicated in this case. Learned counsel further submits that the informant, in her re-statement, has stated that the deceased committed suicide after being harassed and abused by petitioner and others. There is no allegation that this petitioner instigated or provoked the deceased to commit suicide. Petitioner has got clean antecedent and is in custody since 30.09.2024.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the deposition of informant in her restatement and period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East
