The petitioner is languishing in custody for the offences punishable under Sections 399/402/413/414 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act. Co-accused Manoj Kumar Sharma, who was apprehended by the police on suspicion that he and others were preparing to commit dacoity, has already been allowed bail by a coordinate Bench of this Court. Allegation is that petitioner fled away from there. Petitioner is in custody since 23.03.2019. Investigation of the case is already complete. There is no allegation of tampering with the evidence.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.81845 of 2019(2) dt.18-12-2019 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Phulparash P.S. Case No.184 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
