JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing . The petitioner is accused in connection with G.B. Nagar P.S. Case No. 265 of 2018, registered under Sections 302 and 201/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Siwan.

The accusation is that at about 8 A.M., on 17.08.2018, informant, Sona Devi, received information on phone about the murder of her daughter by her husband and inlaws due to quarrel in family. Kundan Kumar, son of her daughter informed that his uncle, Rajat Kumar Sah (petitioner) pressed the neck of his mother and thereafter, all took his mother at cremation ghat.

No.77093 of 2019(4) dt.28-05-2020 2/2 Learned counsel for the petitioner submits that admittedly, petitioner is the brother-in-law of the deceased, daughter of the informant and he has falsely been implicated in the present case mere on suspicion. It is further submitted that it would appear from paragraph 25 of the case diary that witness, Kundan Kumar, son of the deceased, has stated about pressing the neck of his mother by the petitioner due to quarrel and removing the dead body at cremation ghat and when the police came there then all fled away. Postmortem report disclosed 100% burn over the dead body which was brought for postmortem. Further submission is that petitioner is in custody since 23.09.2019.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
