====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 08-12-2025 Heard learned counsel for the petitioner and learned counsel appearing for Bihar State University Service Commission.

2. With the consent of parties the present writ application is being disposed of at this stage itself.

3. The present in the present writ application has prayed for issuance of writ of mandamus to the respondent authorities to appoint the petitioner on the post of Assistant Professor in English because as per the petitioner, the petitioner obtained 85 marks and other candidates who obtained 76 marks

Patna High Court CWJC No.19727 of 2025(2) dt.08-12-2025 2/3 they have been appointed but the petitioner has not been appointed and still, as per the petitioner 44 posts are vacant.

After advancing some argument, learned counsel appearing for the petitioner submits that he is ready to file a detailed representation for redressal of his grievance before the Secretary, Bihar State University Service Commission (respondent no.2). He further prays that if such a representation is filed by the petitioner an appropriate direction be issued to the Secretary, Bihar State University Service Commission to dispose of the representation of the petitioner within a fixed time frame after giving an opportunity of hearing to the petitioner.

5. To the aforesaid submission made by learned counsel for the petitioner, learned counsel appearing for Bihar State University Service Commission does not have any objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner, the present writ application is disposed of granting liberty to the petitioner to file a detailed representation before the Secretary, Bihar State University Service Commission within one month from the date of passing of this order and if such a representation is filed, the

Patna High Court CWJC No.19727 of 2025(2) dt.08-12-2025 3/3 Secretary, Bihar State University Service Commission shall hear and dispose of the same within a further period of six months from the date of filing of the representation, after giving an opportunity of hearing to the petitioner. Needless to emphasize that the final order which shall be passed by the Secretary, Bihar State University Service Commission should be a reasoned and speaking order.
