JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-10-2018 Heard Mr. Siyaram Shahi, the learned counsel for the petitioner and Mr. Mukul Prasad, J.C. to G.P.18 for the State. The petitioner has filed this writ petition for a direction to the District Land Acquisition Officer, Patna, respondent no.4, to dispose of the application of the petitioner and calculate the compensation for acquisition of land of the petitioner of Khata No.246, Plot Nos.2768 and 2770, situated in Village Suitha, Circle- Phulwarisharif, District Patna. The learned counsel for the petitioner submits that the land was recorded in the name of father of the petitioner. The petitioner got two brothers. The petitioner filed petition to calculate the compensation with regard to the land falling in the

Patna High Court CWJC No.18698 of 2018(2) dt.25-10-2018 2/2 share of the petitioner but the Land Acquisition Officer is sitting over the matter and did not dispose of the representation of the petitioner.

Mr. Mukul Prasad, the learned counsel for the State filed counter affidavit annexing Annexure-A and submitted that vide Letter No.2163, dated 13.10.2018, the Additional Land Acquisition Officer, Patna directed the petitioner to submit the documents with regard to the lands but till date no document has been filed.

Having considered the facts and submissions of both sides, I dispose of this writ petition with a direction to the Land Acquisition Officer, Patna to dispose of the representation of the petitioner within three months from the date of receipt of this order after considering the documents filed by the petitioner with regard to entitlement of the extent of compensation by the petitioner.

With the aforesaid direction, the writ petition stands disposed of.
