2. The petitioner has preferred this application for grant of regular bail in connection with Rajepur P.S. Case No. 180 of 2024 dated 07.09.2024 registered for the offences punishable u/s 309(4) of the B.N.S.

3. As per the prosecution case, three unknown miscreants are alleged to have stopped the informant's motorcycle and looted the amount of Rs. 1,81,580/-, key of the bike, documents of the company, Oppo phone and Aadhar Card and fled away from the spot.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of

Nothing has been recovered from the conscious possession of the petitioner. Similar situated co-accused has already been granted bail by this Court vide order dated 05.02.2025 passed in Cr. Misc. No. 86429 of 2024. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the stolen amount and mobile were recovered from the house of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran at Motihari in connection with Rajepur P.S. Case No. 180 of 2024, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.86878 of 2024(4) dt.12-08-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
