2. The petitioner seeks regular bail in connection with Azimabad P.S. Case No. 71 of 2023, registered for the offences punishable under Sections 393 of the Indian Penal Code.
3. As per the prosecution story, when the informant was returning to his home by his motorcycle then three unknown persons on bike who were carrying iron chain in their hands came there and started assaulting and abusing him and tried to rob his valuable and cash. The police arrested them including the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case by the informant. Nothing incriminating articles have been
Patna High Court CR. MISC. No.86098 of 2023(2) dt.16-01-2024 2/2 recovered from the conscious possession of the petitioner. The charge sheet has already been submitted in this case. Similarly situated co-accused namely Prankush Ojha @ Amit Ojha has been granted bail by the co-ordinate bench of this Court vide order dated 08.12.2023 in Cr. Misc. No. 79137 of 2023. Petitioner has no criminal antecedent and is in jail custody since 21.08.2023.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Azimabad P.S.
