The petitioner has been in custody since 09.08.2018 in connection with Gaya Rail P.S. Case No. 249 of 2018 registered for the offences punishable under Sections 30A of the Bihar Excise and Prohibition Act.
Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession, but from the door-way of the bogie and, therefore, the petitioner has been falsely implicated in connection with the present case. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedent.
In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail
Patna High Court Cr.Misc. No.59514 of 2018 (2) dt.28-09-2018 2/2 on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Gaya, in connection with Gaya Rail P.S. Case No. 249 of 2018.
