2. The petitioner apprehends arrest in connection with Manigachhi (Bajitpur O.P.) P.S. Case No. 237 of 2023 instituted under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. The recovery is of 716.76 litres of foreign liquor from a Bamboo orchard.

4. Learned counsel for the petitioner submits that the petitioner is ready to donate Rs. 25,000/- (Rupees Twenty Five Thousand Only) in some charitable organization without accepting his guilt.

5. Learned APP appearing for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the petitioner, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge-II (Excise Court), Darbhanga in connection with Manigachhi (Bajitpur O.P.) P.S. Case No. 237 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

7. This is also subject to the condition that the petitioner shall deposit an amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) in Ramakrishna Mission Sevashrama, Muzaffarpur and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
