The present application has been filed for modification of the order dated 21.2.2018 passed in Cr. Misc. No. 8453 of 2018 by which three petitioners were granted bail in connection with Hathua P.S. Case No. 131 of 2017 to the satisfaction of learned 2nd Additional Sessions Judge, Gopalganj and the petitioners were directed to surrender in the Court below within a period of six weeks and furnish bail bonds.
Learned counsel for the petitioner submits that due to medical ailment, the petitioner was operated and he was advised for rest, hence the present petitioner i.e. Pashpati Sah, who was petitioner no. 2 in Cr. Misc. No. 8453 of 2018 could not
Patna High Court Cr.Misc. No.58878 of 2018(2) dt.20-09-2018 2/2 surrender in the Court below well within time. The other two petitioners surrendered in the Court below and furnished their bail bonds. It is prayed on behalf of the learned counsel for the petitioner that further time may be extended so that the petitioner could surrender in the Court below and furnish bail bonds.
Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the Court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same.
The order dated 21.2.2018 passed in Cr. Misc. No. 8453 of 2018 is modified to the extent as indicated above. The modification application is, accordingly, allowed. (Sudhir Singh, J) Pankaj/- U T
