Petitioners apprehends his arrest in a case, registered for the offence punishable under Sections 279 and 337 of the Indian Penal Code and Section 30 (D) of the Bihar Prohibition and Excise Act.

Allegation is recovery of 10 quintal of Mahua Phool from a pick up van.

It has been submitted that petitioner no.1 is owner and petitioner no.2 is driver of the aforesaid vehicle. Considering the facts and circumstances of the case and recovery of huge quantity of mahua phool from possession,
