2.The petitioner has prayed for regular bail in a case registered for the offence punishable under section 310(3) of Bharatiya Nyaya Sanhita, 2023.

3. The case of the prosecution is that 8 to 10 miscreants being armed with gun entered the house of the informant and looted rupees 10-15 lakhs and jewelleries. It is further alleged that at the time of alleged occurrence, one accused person opened fire which hit the wife of the informant due to which she died.

4.Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During investigation a spy

It is also submitted that though certain articles have been recovered from the possession of the petitioner but TIP of those articles has not been conducted. The petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 15.07.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6.Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Katra (Jajuaar O.P.) P.S. Case No. 116 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Court No-07, East Muzaffarpur.
