JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This is an application for grant of anticipatory bail in connection with Dinara P. S. Case No. 206 of 2019 disclosing offences under Sections 147, 148, 149, 323, 307, 504, 506 of IPC and Section 27 of the Arms Act.

As per F.I.R. petitioner no.1 has assaulted by farsa to the nephew of the informant. So far petitioners no. 2 to 4 are concerned, there is general allegation.

Submission of the learned counsel for the petitioners is that there is case and counter case between the parties. No specific allegation has been attributed against the petitioners no.

Patna High Court CR. MISC. No.76993 of 2019(2) dt.20-01-2020 2/2 2 to 4, though the injury report shows that opinion of the injury report was kept reserved, but that was issued on 10.09.2019 after two months of the occurrence.

Heard learned A.P.P. as well as learned counsel for the informant, who has appeared suo motu, has submitted that Annexure 3 disclosed that nephew was examined on 27.07.2019 though the injury report was issued on 10.09.2019. Having heard both sides, considering the above submissions, so far petitioner no.1, is concerned, I am not inclined to grant privilege of anticipatory bail to him. He has to surrender and pray for regular bail.

So far other petitioners are concerned, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M., Bikramganj, Rohtas, in connection with Dinara P. S. Case No. 206 of 2019.
