JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Bhabua P.S. Case No. 518 of 2019 registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.

As per FIR allegation against the petitioner is that he assaulted the informant by means of rod repeatedly, causing injuries on his head and fracture on his hand. Submission of learned counsel for the petitioner is that he has falsely been implicated as informant has taken money from him and when he demanded the same he has been made accused in this case and as a matter of fact scuffle took place and he received injuries.

Heard learned APP also.

In view of above facts and circumstances, I am not

Patna High Court CR. MISC. No.80522 of 2019(2) dt.21-01-2020 2/2 inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
