This application has been filed for modification of order dated 25.9.2019 passed in Cr. Misc. No.33343 of 2019 on the ground that the order was just one day prior to the date fixed in this case as such the petitioner could not appear. As per the above order conditional bail was granted to the petitioner and both the parties were directed to remain present on that day.

Heard learned APP and the learned counsel for the O.P.no.2 is also present. He has submitted that he has no instruction in this case, however, as he is present, it is expected

As such the date of surrender is extended and the petitioner is directed to surrender on 10.02.2020 and on that day O.P.no2 shall also remain present in the court below and rest of the parts of the order shall remain intact.

With the above modification, this modification application is allowed.

Let a copy of this order be communicated to the learned court below concerned at once.
