The petitioner is aggrieved with the misuse of the government fund in Social Protection Pension and Indira Aawas Scheme in Nawami Panchayat in the District of Madhubani. It appears that the petitioner initially approached the Sub-Divisional Officer-cum-Public Grievance Redressal Officer, Jhanjharpur, , who vide order dated 30.05.2017, passed

Patna High Court CWJC No.20451 of 2018(2) dt.12-10-2018 2/3 in Complaint No.50551-02753, directed the Block Development Officer, Jhanjharpur, to take legal action and informed the Public Grievance Redressal Officer.

It is submitted by learned counsel for the petitioner that the order passed by the Sub-Divisional Officer-cum-Public Grievance Redressal Officer, Jhanjharpur was not complied by the Block Development Officer.

However, learned counsel for the petitioner seeks permission to withdraw the present application with a liberty to file appeal under the provisions of Bihar Right to Public Grievance Redressal Act, 2015 (hereinafter referred to as 'the Act').

In the circumstances, the writ application is permitted to be withdrawn.

However, the petitioner is permitted to prefer appeal under Section 7 of the Act within a period of three weeks from the date of receipt of a copy of this order along with an application for condonation of delay in filing of the appeal, whereupon, the Appellate Authority is expected to consider the appeal of the petitioner within reasonable period under the Act, keeping in view of the fact that the petitioner was pursing remedy before this Court.
