1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Budha Colony Police Station Case No. 149 of 2020, dated 02.06.2020, disclosing offences punishable under Sections 341/323/307/379/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that while the informant had gone to the house of the petitioner for his wages, initially the accused persons gave him Rs. 6,000/- and when the informant was returning with his brother, the petitioner and one Vinod Paswan stopped him, snatched Rs. 6,000/- and assaulted the informant by bricks on his abdomen, due to which he received injuries in his stomach and intestine.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to local politics. He further submits that the alleged incident took place on 13.05.2020, fardbayan of the informant was recorded by the police on 23.05.2020 and the First Information Report was registered against the petitioner and others on 02.06.2020. He further submits that the petitioner has got no criminal antecedent.

On the other hand, learned Additional Public Prosecutor vehemently opposes the prayer for anticipatory bail and submits that though the petitioner is named in the First Information Report and co-accused Vinod Paswan was arrested by the police on 30.10.2020, the petitioner approached the learned Court below for grant of anticipatory bail in the year 2024. He further submits that there is direct allegation against the petitioner of assaulting the informant and the informant has sustained grievous injuries, endangering his life, due to the assault of the petitioner and others.
6. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that the petitioner has approached the Court after four years

No.86394 of 2024(3) dt.08-05-2025 3/3 years of alleged occurrence, there is direct allegation against the petitioner of assaulting the informant by bricks and the informant has sustained grievous injuries, endangering his life, I am not inclined to grant the petitioner privilege of anticipatory bail.
