====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the F.I.R., co-accused Guddu Rai fired bullet at the informant's grandfather, Sadhu Rai, which hit him below the neck, resulting in his death.

4. Learned counsel for the petitioner submits that the specific accusation of committing the murder of the informant's grandfather is against co-accused Guddu Rai, who is alleged to have fired at the deceased. There is a general and omnibus allegation, and no specific allegation of any assault or overt act is attributed to this petitioner. Co-accused persons Sanjivan Ray

No.84215 of 2025(2) dt.04-12-2025 2/2 @ Ram Sanjivan Kumar, Jivanand Ray @ Jiwanand Ray, Yogendra Rai, Gautam Kumar @ Gautam Rai, Sanjeev Rai and Sanjivan Ray @ Ram Sanjivan Kumar, having similar and identical allegations, have already been granted bail by this Court vide orders dated 02.07.2025, 22.08.2025, 17.11.2025, 27.11.2025 and 02.07.2025. The petitioner is in custody since 30.05.2025 and the charge-sheet has been submitted in this case.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Principal District & Sessions Judge, Bhojpur at Ara, in connection with Sessions Trial No. 473 of 2025 arising out of Koilwar P.S.
