The petitioner seeks regular bail in connection with Manjhagarh P.S. Case No. 277 of 2019 for the offence registered under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

The allegation is regarding recovery of 27 liters of illict country made wine from beneath a tree situated near Lahladpur canal.

The learned counsel for the petitioner has submitted that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 23.10.2019.

No.77042 of 2019(2) dt.13-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the illicit liquor has not been recovered from the conscious possession of the petitioner, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise, Gopalganj in connection with Manjhagarh P.S. Case No. 277 of 2019.
