JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 7.11.2017 passed in Cr. Misc. No. 46121 of 2017 and the allegation against the petitioner is of causing death of the son of the informant.

Submission of learned counsel for the petitioner is that petitioner has been in judicial custody since 16.01.2017 and uptil now only one witness has been examined and there is no likelihood of conclusion of trial in near future. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail.

However, since the petitioner has been in custody since

Patna High Court Cr.Misc. No.60152 of 2018 (2) dt.03-10-2018 2/2 16.01.2017, the trial court is directed to expedite the trial and conclude the same as early as possible.

At the same time, Senior Superintendent of Police, Patna is directed to ensure the production of witnesses in the trial court on the date fixed so that the trial be concluded expeditiously. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) sunil/- U T
