The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016 in connection with Special Case No.7631 of 2018 of 2018 arising out of Alamganj P.S.Case No.440 of 2018 pending in the Court of Special Judge(Excise), Patna.

10 liters of country made liquor was recovered from the two wheeler of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the presumption under Section 32 of the Bihar Prohibition and Excise Act, 2016 and reverse burden of proof against the petitioner, I am not inclined to grant

Patna High Court CR. MISC. No.79270 of 2019(2) dt.18-12-2019 2/2 anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
