ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 08.10.2019 in connection with Muzaffarpur Excise Case No.155/19 (P.R. No.40/19) registered for the offence under Sections 30(a), 37(b) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recovery was not from the conscious possession of the petitioner, but only because he was suspected to be in drunken position, the alleged recovery was saddled on his shoulders. It is further submitted that the petitioner is not having any criminal antecedents.

Considering the aforementioned facts and
