====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-12-2025 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Parsa Police Station Case No. 310 of 2025, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act.

3. The prosecution story as per the first information report is that on secret information that one spirit businessman, Viru Singh (petitioner) is about to carry a trip of illegal wine on a scooty vehicle towards Srirampur from Pure Chapra through the Saguni Canal Road, the police party reached at the place of occurrence and apprehended the scooty and its driver after a chase. The driver was identified as Saroj Ram. Viru Singh (petitioner) managed to flee. On search of scooty vehicle bearing Registration No. BR-04AU-3231, total 45 litres of spirit

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case and he has no concern with the seized spirit. Learned counsel further submits that spirit has not been recovered from conscious possession of the petitioner rather it has been recovered from the arrested co-accused Sanoj Ram who had taken petitioner's scooty vehicle which the alleged recovery of spirit has been said to be made on pretext of some urgent work. The petitioner has been implicated in this case only on the basis of secret information.

Regard being had to the submission made by the parties, taking into consideration the fact that petitioner is having criminal antecedents and spirit which may be converted into spurious liquor endangering the life of general people, was recovered from the vehicle owned by the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the prayer for anticipatory bail is rejected.
