The petitioner seeks bail in a case registered for offences punishable under Sections 30 (a) and 30 (d) of the Bihar Prohibition and Excise Act, 2016.

As per allegation, the petitioner was seen standing in a semi-constructed house and seeing the police party he escaped and from semi-constructed house utensils and other articles related to preparation of making country-made liquor, Jawa Mahua and Mahua liquor were recovered. It is contended that nothing has been recovered from the conscious possession of the petitioner and he has been falsely implicated in the present case and has no connection with the seized articles . Petitioner claims that he is in custody since 16.7.2018. It is stated in

Patna High Court Cr.Misc. No.59180 of 2018(3) dt.08-10-2018 2/2 paragraph no. 3 that petitioner is accused in a criminal case registered under different Sections of Indian Penal Code but not under any provision of Bihar Prohibition and Excise Act, 2016. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Banka, in connection with Chandan (Anandpur) P.S. Case No. 104 of 2018 If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
