JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-11-2018 Petitioner prays for bail in connection with Gwalpara (Arar O.P.) P.S.Case No. 69 of 2018 registered for the offence punishable under Section 302 of the Indian Penal Code. A dead body was recovered lying in the bank of Sursar river under Rakiya village by Chaukidar and the same was informed to the police. It appears that petitioner is not named in the FIR and later on his name transpired in the confessional statement of co-accused.
Submission of learned counsel for the petitioner is that except confessional statement there is nothing against the petitioner and two co-accused having similar allegation have already been granted bail by co-ordinate Bench of this Court vide order dated 10.10.2018 in Cr.Misc.No. 55879 of 2018 and vide order dated 1.11.2018 in Cr.Misc.No. 61976 of 2018 and
Patna High Court Cr.Misc. No.59062 of 2018(3) dt.28-11-2018 2/2 petitioner is in custody since 22.5.2018.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Udakishunganj at Madhepura, in connection with Gwalpara (Arar O.P.) P.S.Case No. 69 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
