JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 244 of 2018 arising out of Purnea Sadar P.S. Case No. 156 of 2018 instituted for the offence under Sections 341, 342, 363, 370 and 120(B) of the Indian Penal Code.

Counsel for the petitioner submits that victim (father of the informant) on recovery has given statement under Section 164 Cr. P.C. wherein he has narrated totally different story from the allegation made in the written report. He has not levelled any allegation of overt act against the petitioner. The statement of victim (father of the informant) has been enclosed as Annexure-2. Petitioner is said to be in custody since 19.04.2018. Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.59581 of 2018 (2) dt.06-10-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned IIIrd Additional Sessions Judge, Purnea, in connection with Sessions Trial No. 244 of 2018 arising out of Purnea Sadar P.S. Case No. 156 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
