2. The petitioner apprehends his arrest in a case registered under Sections 376, 504 and 34 of the Indian Penal Code.

3. As per prosecution case, on the alleged date and time of occurrence, when daughter of informant went to attend call of nature in the meantime, this petitioner tied her mouth by towel and started teasing her and when she objected, petitioner pushed her and committed rape upon her. The victim in her statement recorded under Sections 161 and 164 Cr. P.C. has supported the prosecution case.

4. Considering the nature of accusation and the gravity of offence as well as statement of victim recorded under Sections 161 and 164 Cr. P.C., this Court is not inclined to grant

Patna High Court CR. MISC. No.90139 of 2024(2) dt.05-02-2025 2/2 anticipatory bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected.
