None appears for the opposite party no.2. However, names of Mr. Gyanendra Kumar Singh and Mr. Kamlesh Prasad appear in the daily cause list on behalf of opposite party no.2.
The petitioner, being the husband of the informant, is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act.
The prosecution case as per the written report of the informant submitted to the Station House Officer of Ram
Patna High Court CR. MISC. No.63234 of 2018(5) dt.09-04-2019 2/3 Krishna Nagar Police Station is to the effect that the marriage of the informant was performed with the petitioner on 21.11.2016 but after the marriage, torture was inflicted by the petitioner and other in-laws family members for non-fulfillment of the further dowry demand and in spite of best effort the issue could not be reconciled.
It appears that the matter was referred to the Patna High Court Mediation Centre. The report of the Mediator dated 14.03.2019 at Flag 'M' reflects that the issue has been settled between the parties in terms of payment of one time settlement amount of Rs.16,00,000/- (Sixteen lacs) in two installments and the Maruti car which was given to the petitioner by the informant's family will be returned to the informant. Considering the fact that the issue has been resolved between the parties and learned counsel for the complainant chose not to oppose the prayer for anticipatory bail of the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge XIII -cum- ACJM, Patna in connection with
