26-02-2020 Heard learned counsel for the parties.

The petitioners apprehend their arrest in Mansi P.S. Case No. 106 of 2018, G.R. No. 1476 of 2018 registered for the offence under Section 307 & other allied sections of the I.P.C. It is submitted on behalf of petitioners that both parties are relatives and due to minor dispute, the scuffle has taken place between both sides and a false case has been lodged. There is general and omnibus allegation. It is further submitted that injuries received by the prosecution side have been found to be simple in nature by the doctor. Petitioners have no criminal

Learned counsel for the opposite party no. 2 as well as State have opposed the prayer for bail.

However, considering the aforesaid facts and circumstances as well as nature of accusation, in the event of their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khagaria in connection with Mansi P.S. Case No. 106 of 2018, G.R. No. 1476 of 2018 on the following conditions:

"(1) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail-bonds shall be cancelled by the Court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
