JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This is an application for grant of anticipatory bail in connection with Barauli P.S. Case No. 328 of 2019, disclosing offence under Sections 341, 323, 354, 448 and 504 of Indian Penal Code.

Prosecution case is that petitioner entered inside the house of the informant, tried to outrage her modesty. Submission of learned counsel for the petitioner is that there is delay of six days in lodging of the F.I.R. Moreover, there is a land dispute between the parties. The girl has refused to record her statement u/s 164 of Cr.P.C. that clearly shows that petitioner has falsely been implicated in this case, due to land dispute.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.76995 of 2019(2) dt.20-01-2020 2/2 submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No. 328 of 2019.
