JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 This application, for grant of anticipatory bail, arises out of Beldaur P.S. Case No. 105/2016, disclosing offences under Sections 498(A)/34 of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act.
Petitioner happens to be husband of the informant and allegation against him is of subjecting the informant to cruelty in connection with demand of dowry. Further allegation is that he confined the informant in courtyard and only on the intervention of the police, she could be released. Submission of learned counsel for the petitioner is that entire allegation is false and concocted and he is still ready to keep the informant with full honour and dignity
Patna High Court CR. MISC. No.77634 of 2019(2) dt.02-12-2019 2/2 Heard learned A.P.P. also and perused the impugned order, from which, it appears that in the court below the petitioner has made submission that informant is not his wife and here is taking different stand.
In such view of the matter, considering the conduct of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner, however, he is at liberty to approach the informant and persuade her to live with him and if she is ready to reside with the petitioner, petitioner has to make such submission before the court below while praying for grant of regular bail and the court below after considering the aforesaid aspect shall dispose of the prayer for regular bail of the petitioner.
This application is accordingly disposed of.
