2. Lastly, the prayer for bail of petitioner was rejected, vide order dated 03.11.2023 passed in Cr.Misc. No. 56710 of 2023 with an observation to expedite and conclude the trial within a period of one year.

3. Learned counsel for the petitioner submits that in spite of observation of this Court, the trial has not concluded and out of 8 charge-sheeted witnesses, only 2 witnesses have been examined. Petitioner is in custody since 07.11.2019.

4. Learned A.P.P. for the State vehemently opposed the bail petition.

5. Considering the period of custody and tardy progress of trial, let the above named petitioner be released on

Patna High Court CR. MISC. No.88836 of 2024(3) dt.02-05-2025 2/2 bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. - VIII, Siwan in connection with Sessions Trial No. 397 of 2021, arising out of Daraunda P.S. Case No. 181 of 2019.
