The petitioner seeks bail in Ara Nagar P.S. Case No.399 of 2018 registered under Section 394 of the Indian Penal Code and later on, Section 25(1-b)a, 26 and 35 of the Arms Act was added.

The informant lodged the F.I.R. against unknown for committing robbery of Rs.4,70,000/-, mobile and other articles from the petrol pump.

The learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. From the joint house of the petitioner, one magazine live cartridge of 7.65 bore, one Samsung mobile, Rs.8,000/- and other articles, which are said to have been looted, was recovered. Mobile was not put on T.I.P. Five live

Patna High Court Cr.Misc. No.61731 of 2018 (2) dt.08-10-2018 cartridges were recovered from the joint house of the petitioner. Even the recovered money was not put on T.I.P. Petitioner is in jail since 17.07.2018 but he has not put on T.I.P., although, the staff of petrol pump claimed to identify the accused persons and their activities are also figured in the CCTV camera installed in the petrol pump.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that although, the petitioner is in jail for more than 2 1⁄2 months but petitioner has not been put on T.I.P. nor Samsung mobile and the money which are said to have been recovered from the house of the petitioner are put on T.I.P., the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nagar P.S.
