2. The petitioner seeks bail in connection with Bihta P.S. Case No. 697 of 2023 registered for the offence under Section 392 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are accused of looting a Swift Desire Car.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and he is named in this case only on the basis of confessional statement of other co-accused. He further submits that no material has come against him to connect him with the crime and there is no recovery and no TIP held yet.

5. It is also submitted by the learned counsel for the

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Danapur in connection with Bihta P.S. Case No. 697 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Koilwar Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
