The petitioner seeks bail in connection with Jankinagar P.S. Case No. 129 of 2019 registered for the offences punishable under Sections 356, 379, 34 of the Indian Penal Code. The prosecution case in short is that the informant namely Niraj Kumar has alleged that he is posted as D.B.O. in Bandhan Bank. It is further alleged that on 17.08.2019, he was going to deposit the cash Rs.55,680/- fro Murliganj, but when he reached near Thakur Patti and Jagdishpur near Basbatti of Lakshman Paswan by without number Apache Motorcycle three unknown miscreants came and snatched his Mobile Redme Company white coloured screen and other articles were kept. It is further alleged that with
Patna High Court CR. MISC. No.77732 of 2019(2) dt.29-11-2019 2/3 regard to alleged occurrence, informed to Manger by telephonic massage. It is further alleged that the informant came to know the involvement of the petitioner through his personal source along with two other miscreants.
Learned counsel for the petitioner submits that neither the petitioner was caught at spot nor the alleged articles have been recovered from possession of the petitioner. Learned counsel for the petitioner further submits that the informant's Redme Company white coloured screen Touch Mobile has been snatched by the alleged miscreants whereas from the possession of the petitioner one golden coloured Samsung Company's old screen Touch Mobile has been recovered. He further submits taht Rs.4,000/- was recovered from the petitioner which was kept by the petitioner for purchasing a bicycle. Learned counsel for the petitioner further submits that till date no T.I.P. has been held. He further submits that the charge sheet has been submitted against the petitioner. There is no allegation against the petitioner to tamper with the witnesses.
Petitioner is in jail custody since 19.08.2019. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Janki Nagar P.S. Case No.
Patna High Court CR. MISC. No.77732 of 2019(2) dt.29-11-2019 3/3 the following conditions :
(1) One of the bairlors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the investigation, if not already concluded and make himself available and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
