2. The petitioner is apprehending his arrest in connection with Panchanpur P.S. Case No.92 of 2025, F.I.R dated 08.05.2025 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Control/Amendment Act, 2018.

3. As per the prosecution case, on 08.05.25, during vehicle checking, informant along with police personnel intercepted a Nexon Car bearing reg. no. BRO1HE-1440, where co- accused (driver) was apprehended on spot. On search 02 bottles of Royal Stag Premier Whiskey each of 375 ml. (total 750 ml.) of illicit foreign liquor was recovered from the car

Patna High Court CR. MISC. No.82544 of 2025(2) dt.10-12-2025 2/3 which was hidden in the dickey of-the car and accordingly seized on spot. It was alleged that the petitioner was owner of the seized car from which the liquor was recovered.

Learned counsel for the petitioner submits the petitioner is the owner of the car, which was given to his cousin for marriage purposes and in the course of the same, he was arrested with 750 ml of foreign liquor, is said to be recovered from the dickey of the car, which was almost an empty liquor bottle. It has next been submitted that the petitioner has clean antecedent and is in no way connected with the alleged offence and at the time of seizure, he was not present in Patna.

5. Learned APP for the State opposes the prayer for anticipatory bail application.

Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the constructive possession and / or premises belonging to the petitioner and that the vehicle at the time of arrest was being used by his cousin and the petitioner is in no way connected with the illicit liquor, accordingly, this Court is inclined to grant anticipatory bail to the petitioner.

7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the
