====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 08-05-2025 Heard Mr. Krishna Prasad Singh, learned Senior Counsel for the petitioners, Mr. Praveen Kumar Agrawal for the informant as also Mr. Aditya Narayan Singh, No.1, learned APP.
2. The petitioners apprehend their arrest in connection with Farbesganj P.S. Case No. 422 of 2024 for the offence registered under sections 341, 323, 324, 307, 302, 147, 148, 149, 354(B), 504, 342 and 506 of the IPC lodged on 30.06.2024 by the informant, Sanju Devi.

3. As per the prosecution story, the informant alleged that the accused Brajesh Kumar came to the informant's house requesting the informant's husband (since deceased) to attend a meeting with his family to end the land dispute between them. She later sent her daughter to call her husband but the daughter came and informed that he is being abused/assaulted. When she went to the place, saw her husband tied in a rope and was continuously beaten by all the accused persons. As she tried to save her husband, Sandhaya Devi and Parwati Devi (petitioner nos. 1 and 3 respectively) caught hold of her, the husband died which followed the FIR.
4. Learned Senior Counsel for the petitioners submit that main role is against Brajesh Kumar who took the deceased to his house whereafter, the dead body was found, only to implicate the entire family members, have been named, two of them are ladies.
5. Learned counsel representing the informant, on the other hand, submits that only due to land dispute, the entire family members participated in the crime which led to the death of the husband of the informant. He further submits that Brajesh Kumar Mehta, the son of the accused herein is in jail and his bail application has been rejected by the Co-ordinate Bench in
Patna High Court CR. MISC. No.88458 of 2024(3) dt.08-05-2025 3/3 Cr. Misc. No. 3903 of 2025.

In this case, the Co-ordinate Bench had called for the case diary and paragraph 25 records the statement of the minor daughter of the deceased and she has narrated how brutally the accused persons assaulted which include all the petitioners herein and further the two ladies caught hold of the informant so that she could not save her husband.
7. All these facts/allegations that has come against the petitioners herein, it takes the Court to only one conclusion, they are not entitled for any relief, the anticipatory bail application stands rejected.
