Petitioner apprehends his arrest in a case registered for the offence punishable under Section 47(a) of the Bihar Prohibition and Excise Act, 2016.

Informant who is police officer in his written report has alleged that illicit liquor was recovered from two motorcycles which were lying abandoned and the four miscreants riding on said motorcycle fled away. It has been submitted on behalf of the petitioner that he is not named in the FIR. He has been implicated in this case at the belated stage of investigation after three years of institution of FIR. Petitioner has got no criminal antecedent. Nothing has been recovered from the possession of the petitioner.

No.79920 of 2019(2) dt.09-12-2019 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above in the event of his/her arrest or surrender before the court below within a period of four weeks, be released on anticipatory bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Govindpur P.S. Case No. 57 of 2016, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
