JUSTICE MADHURESH PRASAD ORAL ORDER 17-01-2020 Heard learned senior counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 376, 511/34 of the IPC and sections 8/12 of POCSO Act. Allegation in the F.I.R is that on pretext of showing prospective rental premise to the informant, petitioner and his elder brother have tried to outrage modesty of the informant. Senior counsel representing the petitioner submits that it is case of false implication and the prosecution has been lodged under misconception. Petitioner is in fact, younger to the informant. He has falsely been implicated on extraneous consideration. With intervention of common friends and well wishers normalcy has been restored. Informant has also filed joint compromise petition in the court below (Annexure 2 to the

Patna High Court CR. MISC. No.86252 of 2019(2) dt.17-01-2020 2/2 instant petition).

Petitioner prior to instant case has no criminal antecedent and he is in custody since 04.09.2019. Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I-cumSpecial Judge, POCSO, Patna in Alamganj P.S. Case no. 651/2019 corresponding to Special (POCSO) Case no. 172/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
