The petitioner seeks bail in connection with Gaighat P.S. Case No.239 of 2019 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 90 liters of Haryana Made illicit foreign liquor from the house of the petitioner. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent and petitioner is in jail custody since 12.10.2019.

No.77822 of 2019(2) dt.29-11-2019 2/2 In the facts and circumstances of the case, I am inclined to grant bail to the petitioner subject to deposit of Rs.15,000/- in the court below/ Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise Act, Muzaffarpur in connection with Gaighat P.S. Case No.239 of 2019.

Such deposit of Rs.15,000/- shall abide by the outcome of the criminal case.
